Supplemental Uninsured Motorist/Uninsured Motorist (SUM/UM)
With respect to SUM/UM claims, the Firm’s attorneys advise insurance carriers regarding their rights and obligations under the policy during the investigation of the claim. This may include conducting an Examination Under Oath of the claimant, analyzing the carrier’s coverage obligations, and assessing the claimant’s level of fault and damages.
The Firm’s attorneys can also prepare and file a Petition to Stay Arbitration within hours of the file assignment, helping the carrier avoid the waiver of coverage issues that results from a failure to file the Petition within the 20-day statutory period.
We have the knowledge and experience to secure a favorable result at the framed issue hearing on any/all of the potential coverage defenses. Similarly, we have the ability to successfully raise and support defenses based on fault and failure to establish a “serious injury” at a SUM/UM arbitration before the American Arbitration Association.
